Pekerja kerja 4 tahun lebih, majikan tak bayar gaji - kini Pejabat Buruh kata tak boleh bantu kerana pekerja tak ada dokumen/pas perlu?

Pekerja perempuan  telah bekerja untuk empat setengah tahun sebagai pekerja domestik(domestic worker) dan pembantu kedai - majikan tak bayar gaji? Adil atau tidak?

Majikan sudah mendapat hasil kerja pekerja dan kini enggan bayar gaji tertunggak...lebih kurang RM30,265.32 dituntut...

Bila masuk kerja, pekerja dikatakan akan dibayar gaji RM770 tetapi akhirnya majikan hanya kata akan membayar RM550-00.

Kes pekerja ini dibawa kepada Pejabat Buruh(Sumber Manusia kini) tetapi pihak Kementerian tidak mahu bertindak kerana dikatakan pekerja itu 'tidak ada dokumen kerja' ...justeru 'pendatang haram'...pendatang tanpa izin ...atau 'kerja tanpa permit'...

Ikut undang-undang Imigresen, pekerja, majikan dan ejen berkenaan telah melanggar undang-undang dan tindakan undang-undang harus diambil....TETAPI isu lain

Isu pekerja dan majikan adalah isu Kementerian Sumber Manusia...pekerja itu telah kerja dan majikan menikmati faedah kerja berkenaan, justeru harus membayar gaji...sedih bila Kementerian Sumber Manusia berasaskan fakta pekerja itu tidak ada permit sah? [Kemungkinan besar, pekerja perempuan ini telah ditipu ejen dan majikan ...dia mungkin tak sedar bahawa dia tidak ada hak kerja tanpa permit, atau dia perlu permit untuk kerja..]

Perkara yang Kementerian Sumber Manusia lihat adalah..

1. Sama ada kontrak perkhidmatan di antara majikan dan pekerja? Dalam kes ini, pasti ada - kalau tidak kenapa perempuan itu kerja empat setengah tahun...pasti dia adalah pekerja... kalau bukan pekerja, adakah dia 'HAMBA ABDI' kerja percuma untuk bos kerana tak ada pilihan. YA - dia pekerja dan kontrak perkhidmatan(kontrak kerja) ada...Bila pekerja mengadu majikan tak payar gaji, Kementerian harus memulakan kes - pastikan sama ada benar, dan jika ada gaji terhutang - Kementerian(atau Mahkamah Buruh) harus pastikan majikan bayar gaji tertunggak...termasuk juga mengambil tindakan saman tambahan terhadap majikan kerana keingkaran Akta Kerja - gaji bulanan harus dibayar setiap bulankan..

2. Jika melihat Akta Kerja, saya percaya ia tidak mengatakan pekerja sah atau tidak sah...ianya hanya kata 'pekerja'... isu 'imigresen' bukan isu Kementerian Sumber Manusia atau Mahkamah Buruh.

3. Sedih tindakan Mahkamah Buruh menolak kes ini atas alasan pekerja wanita ini adalah pekerja asing tak ada dokumen perlu...kini kes di Mahkamah Tinggi.

4. Sama ada pekerja 'tak ada dokumen' atau ada bukan isu - pekerja sudah bekerja, majikan masih tak bayar gaji atau hutang gaji adalah isu.

5. Jika semua pekerja asing tak berdokumen tidak boleh pergi menuntut/mengadu kesalahan majikan - manakah pekerja sedemikian pergi? Jika ini pendirian Mahkamah Buruh(Kementerian Sumber Manusia), senang sekali majikan menindas/menipu pekerja asing lepas itu batalkan permit menjadikan mereka pekerja tak sah(haram) - dan Pejabat Buruh tidak akan bantu..

6. Banyak ejen/majikan menipu pekerja asing - mereka kata semua OK..ada permit, dsb... pekerja kerja, majikan tak bayar selepas terima faedah kerja - Adakah ini OK?

MTUC, kesatuan dan pekerja di Malaysia harus bantu menjamin hak pekerja tidak dicabul...


 

Decision on undocumented worker's right to claim unpaid wages deferred

The Shah Alam High Court has deferred its decision on whether an undocumented worker has the right to claim over four years of unpaid wages, according to human rights group Tenaganita.

The group said the court wants to seek clarification from Wisma Putra and the Human Resources Ministry on whether Malaysia is a party to the International Labour Organisation’s (ILO) Convention on Migration for Employment and the Migrant Workers (Supplementary Provisions) Convention, before making a decision on the right to redress for undocumented migrant workers.

It said the claimant’s lawyers will write to the Foreign Affairs Ministry and Human Resources Ministry as instructed by the judge.

“They hope to obtain a speedy response from the government agencies,” Tenaganita said in a statement last night.

The court has set April 15 as the date for the decision, it added.

The case concerns Indonesian national Nona (not her real name), who had been employed as a domestic worker and shop assistant for four-and-a-half years.

She told Malaysiakini that she did not see any of her RM550 monthly wages, which is less than the RM700 wage that she was promised by an agent before leaving her hometown.

She had filed claims amounting to RM30,265.32 through the Port Klang Labour Court with help from Tenaganita in 2018.

However, labour director-general Misswandi Pardy rejected her claims, saying that undocumented workers have no right to file claims at the Labour Court.

They then appealed against the Labour Court decision at the Shah Alam High Court.

“Tenaganita’s position is that notwithstanding the fact that Malaysia has not ratified the ILO Convention (97) on Migration for Employment and the Migrant Workers (Supplementary Provisions) Convention, 1975, Malaysia is nevertheless a party to and bound by the Universal Declaration of Human Rights, the International Covenant on Economic, Social and Cultural Rights and the International Covenant on Civil and Political Rights to protect the rights of all human beings, including undocumented migrant workers.

“Furthermore, as a member of the International Labour Organisation (ILO) Malaysia is bound to respect the rights of all migrant workers in line with the ILO Declaration on Fundamental Principles and Rights at Work (1998),” Tenaganita said. - 6/3/2019, Malaysiakini
