Police committing crimes - almost 2/3 (or 2,312 cases) classified NFA(No Further Action)?

A problem arises when police have to investigate crimes committed by police - and that is why we need an independent body to investigate crimes committed by police in Malaysia.  The Minister tells us that for almost two thirds of the cases investigated for crime, they have been classified as NFA - No further action.

We recall the death and custody case of Syed Mohd Azlan Syed Mohamed Nur, where the Enforcement Agency Integrity Commission (EAIC) said that the police officers should be investigated, and possibly charged for murder. That was on 30/10/2015 - has anything happened? Or has this case also been classified as 'NFA" (No further action??)

“There was an element of crime in the attacks involving common intent or abetment by PDRM officers, including the arresting team, to intentionally use physical violence on the deceased to cause death or injury,” the EAIC said in a statement today.

It added that the action was a criminal offence, specifically under Section 302 and 325 of the Penal Code read with Section 34 of the same Act.

Section 302 pertains to murder while Section 325 involves voluntarily causing grievous bodily harm; Section 34 deals with voluntarily causing hurt.

PARLIAMENT No action was taken against almost two-thirds of police personnel investigated for involvement in crime for the last five years.

Of the 3,677 cases investigated from 2010 to 2015, 2,312 cases were marked as 'No Further Action' (NFA), Home Minister Ahmad Zahid Hamidi said in a written parliamentary reply today.

He said 521 police personnel have been charged while 844 cases are still under probe.

He added the police as the main enforcement agency in Malaysia practices zero tolerance of crime within the police force.

"Investigations will be conducted transparently and fairly without consideration for the personnel's position or rank if there are reports or complaints about involvement in abuse of power of criminal activities," he said.

Ahmad Zahid added that the police force's Integrity and Standards Compliance Department constantly undertake measures to ensure members of the force abide by the rules and laws.

He said the measures include proactive spot checks on personnel on the front line and undercover work to observe if those in the field are complying with rules and instructions.

Furthermore more, urine tests are also conducted on police personnel to ensure that they are not using drugs, he said.

Other measures include anti-corruption campaigns and corrective action through the religion and counselling division. -
