All 4 shot dead by police? No shot and arrested suspects, No injured police - BEST investigation by some other but Police.

Odd - another 4 shot dead by police - again seem to be no suspect was arrested. This is a NEW incident - this time in Batu Pahat, Johor. In December 4 were shot dead in Sungai Buluh...

When all the suspects get killed - there is no one to give the other side's story - and the fact that the police are conducting the investigation is of great concern - for evidence may be tampered with or even destroyed - this was a finding of the Enforcement Agency Integrity Commission (EAIC)  into Syed Mohd Azlan Syed Mohamed Nur’s 2014 death in custody, the Enforcement Agency Integrity Commission (EAIC)- see also Police officers that tortured and killed detainee - what will the AG and the Malaysian government do?

“There was an element of crime in the attacks involving common intent or abetment by PDRM officers, including the arresting team, to intentionally use physical violence on the deceased to cause death or injury,” the EAIC said in a statement today.

...its investigations also found attempts to obscure evidence from the 25-year-old’s interrogation that resulted in 61 separate injuries on various parts of his body...

Do Malaysians trust the police? We all remember how the police denied causing Anwar's black eye - and then later admitted they caused 'black eye'...Sadly, Anwar did not the pursue the civil suit until the end, and if he did we would have a court judgment that would be very important.

Whilst almost no criminal prosecution has been commenced against police officers with regard to death caused by police - several civil actions have been successful.

In the recent police shooting case, that resulted in all 4 alleged suspects being shot dead...the Johor police chief had this to say in response to statements issued by a human rights group


Johor police chief Ayob Khan Mydin Pitchay has advised a rights group to read carefully his statement on a recent shooting before making allegations about their actions.

Speaking to FMT, Ayob said he went through the group’s statement and denied the police shot the suspects to prevent them from running away.

“There is no question of (the suspects) running away,” he said.

“The suspects fired at us (police) first. They think we fired because we wanted to stop them (suspects) from running away.

“Ask them to read and understand my oral and written statement first (before commenting).”

Where exactly is that written statement of the police.

Once again, the police misses the point - all we want is for someone else(not the police) to investigate cases where police shot and killed all suspects, or cases of death in police custody. The police in such cases are SUSPECTS - and as such we some other(not the police) INDEPENDENT person/body to conduct the investigation..

Why is the police worried if they did no wrong - the Independent Investigator will find the TRUTH - and will also show whether the police followed the law or not...committed a crime or not.

Who can be this INDEPENDENT investigator - well, it could be the CORONER(a Magistrate or Judge), for after all our law requires there by INQUIRIES INTO DEATH when anyone dies...

Alternatively, maybe a Public Prosecutor could investigate - or SUHAKAM(The Human Rights Commission) or the Enforcement Agency Integrity Commission (EAIC).

Whoever is that INDEPENDENT investigator, they must be be involved right from the begining - the risk of tampering of evidence ...even witnesses is there if the Investigators arrive too late.

ALL police officers involved must be SUSPENDED pending inquiry 

The Johor case raises questions - was it just one normal police car, with 2 police officers doing routine patrols  >> Then these 2 police officers may be HEROS for getting in a gun battle with 4 and shooting all 4 dead without sustaining any injury to themselves...OR was there more police officers?

Were the police armed with usual weapons or what...

But wait, this was not police officers from the police station or the police district BUT 'a team from the state contingent’s Criminal Investigation Department' - what were they doing there? Stopping suspicious cars? 

Was there body cams, patrol car cams, VDO recordings of the incident - there are many many questions really and all doubts can be erased if there was an INDEPENDENT inquiry by the Coroner, the Public Prosecutor, SUHAKAM or EAIC..

Police officers from the 'the state contingent’s Criminal Investigation Department' -and the police investigating are from the State. If the investigation was conducted by Bukit Aman or some Federal police - or from another state - there will lesser doubts..

Was the Johor police chief Datuk Ayob Khan Mydin Pitchay present at the scene? His conclusions are but his own opinion, possibly also affected by his 'loyalty' or responsibility for the police officers in his State. Where can we see his statement? Some media should really publish it..

The incident happened on the 12th, and how can anyone make conclusions of what exactly is the Truth in 2 days? Remember, our law allows for remand from 7 - 14 days for the purposes of police completing their investigations..

What were the police officers wearing - the ordinary police uniform or some other attire? If some other attire, the suspects may have been in fear that some group of criminals were trying to 'kill' them? Did the police clearly identify themselves? So many possible questions...How many police vehicles to stop 2 suspect vehicles?

INDEPENDENT Inquiry/Investigation right after the incident is needed..

BATU PAHAT, Feb 12 ― Four suspected armed robbers were shot dead in an exchange of fire with police at Jalan Pagoh-Parit Sulong here early this morning.

Johor police chief Datuk Ayob Khan Mydin Pitchay said the 3.15am incident occurred when a team from the state contingent’s Criminal Investigation Department stopped a Perodua Myvi and Toyota Avanza which were being driven in a suspicious manner.

He said the team tried to approach them for inspection, but two suspects in the Toyota Avanza suddenly acted aggressively and fired a few shots at the police.

“At the same time, two suspects in the Perodua Myvi car tried to escape before a scuffle ensued. The suspects also attacked the police with a machete and a dagger, injuring an officer.

“Out of self-defence, the police then fired back at the suspects,” he told reporters at the Batu Pahat district police headquarters here today.

Ayob Khan said the suspects, believed to be foreigners, aged between 23 and 40 did not possess any personal identification document.

He said in the incident, the police also discovered a black revolver with six bullet shells, four bullets, two machetes, a dagger as well as several tools believed to be used for robbery and burglary.

Also seized were two vehicles which had been reported missing, he added.

“All the bodies were taken to the Enche’ Besar Hajjah Khalsom Hospital in Kluang for post mortem while the officer who suffered minor injuries on his right arm was sent to the Batu Pahat Hospital here for treatment,” he said.

Ayob Khan said the case was being investigated under Section 307/186 of the Penal Code. ― Bernama - Malay Mail,12/2/2021

JOHOR BAHRU: Johor police chief Ayob Khan Mydin Pitchay has advised a rights group to read carefully his statement on a recent shooting before making allegations about their actions.

Speaking to FMT, Ayob said he went through the group’s statement and denied the police shot the suspects to prevent them from running away.

“There is no question of (the suspects) running away,” he said.

“The suspects fired at us (police) first. They think we fired because we wanted to stop them (suspects) from running away.

“Ask them to read and understand my oral and written statement first (before commenting).”

In a statement yesterday, Eliminating Deaths & Abuse in Custody Together (EDICT) questioned whether police adhered to their standard operating procedures (SOPs) when they shot dead four suspected armed robbers in Batu Pahat, Johor, on Friday.

Ayob said he is awaiting a full report on fingerprints found at the scene before issuing further statements on the case.

The NGO yesterday questioned whether police SOPs on shootings, as stated in the Inspector-General of Police’s Standing Orders D222, were followed during the incident.

Stating that the SOP calls for the discharge of a weapon to be made within reasonable grounds, EDICT questioned why the police did not shoot at the suspects’ legs first, as stated in the standing order.

Ayob said the shooting occurred when a team from the state contingent’s Criminal Investigation Department stopped two cars which were being driven in a suspicious manner.

Upon approaching the cars for inspection, two suspects suddenly acted aggressively and fired a few shots at the policemen, with the other two suspects starting to attack the police with a machete and a dagger, injuring one officer.

Ayob said the police then fired back at the suspects in self-defence.- FMT, 14/2/2021
