The Kedah State Education Department
(JPN Kedah) has expelled the teenagers allegedly involved in a gang rape
incident and the circulation of an obscene video at a school in the
state.
Shocking, again the Minister of Education - how can your Education Department EXPEL students suspects - did you forget the Presumption of Innocence Until Tried and Convicted by Court?
The Minister or the Government must not act based on rumors and public sentiments at the moment - just to appease the masses.
You must act according to the RULE OF LAW and legal principles of human rights and justice - and yes, that includes the rights of students suspected of crimes (not even accussed or charged in court - let alone tried and convicted)... and how can the Education Ministry violate Malaysian students right to education.
When Najib, Zahid Hamidi and many MPs were suspected of crimes - were they EXPELLED from Parliament? When they were charged in court, were they EXPELLED from Parliament? When they were convicted and found guilty by Court, were they expelled from Parliament? When their final appeal at the courts confirmed their conviction and sentence, were they expelled from Parliament?
So, why the different standards for this student suspects? Why this 'PRE-CONVICTION punishment?
It is wrong - so very wrong > If the situation requires the students, victim of prejudice by other students and teachers, making it difficult and/or impossible to continue their studies in the same school, the the Ministry with the consent of these student suspects(and their parents/Guardians) come to a decision of what is best so that their right to education is not violated. One possibility is the transfer to another school nearby...
Focus must be also EDUCATING students/teachers/parents of other students about the presumption of innocence, and to be patient and not jump to any conclusions of guilt or innocence until the trial is over, and the Court decides on the guilt and sentence.
Even, if guilty, Malaysia still respects the right to education, and even detainees/prisoners have the right and opportunity to continue their studies and take exams - so their right to education is not violated.
It is not for the Minister or the Kedah Education Department(under the Minister) to decide on whether the said student suspects are GUILTY of the crimes they are alleged to have committed.
What happens if they are ultimately found not guilty - can the violation of their right to education be remedied later? Nope... As it is, these suspects maybe suffering the prejudice of the masses..
Let's be patient - let us see whether they be even charged in court? Whether they are found guilty in court?
MEDIA must be careful too - these are mere allegations - not proven facts, and the suspects are young people, students... Reports must be based on FACTS - what if the allegations are found to be FALSE later - consider the prejudice and the effect on the life of these young people in the future....As such, be careful about adding fuel to the fire - on past unproven allegations..
It was learnt that the suspects were allegedly involved in sexual acts in several classes at the school between May and August.
If, even true, can we blame the school and even the Minister for failing to ACT on this allegations - for if they had acted then, there would be no further crimes including present allegations. So, should we INVESTIGATE the school and the Ministry - for they may be BLAMED for what happened later - because of a 'tidak apa attitude' - or maybe there were NO such past allegations - and no reports was made to the school or the Education Department - so is the allegations about May and August events baseless - worse FAKE news..Was there any police report made?
Even if the police is the source - we must be careful - for whenever anyone gets shot dead by police - they always talked about past 'criminal records' - true or not is always questionable? If someone has a past criminal record, if true, he would reasonably already been charged, tried and convicted - sentenced. But the police in most cases, does not tell us about past convictions and sentences... do they now?
Careful - my MEDIA friends? 'Past allegations' may be false - more so if there is no record on any report, investigation and finding by the school, Education Department or the police/courts. These are serious crimes of sexual acts - and these suspects, if true, would have been already sentenced to incarceration in some facility... ???

PETALING JAYA: The Kedah State Education Department (JPN Kedah) has expelled the teenagers allegedly involved in a gang rape incident and the circulation of an obscene video at a school in the state.
JPN Kedah said immediate action had been taken to assist the victim, with priority given to ensuring her well-being.
“The case is currently under police investigation, and all suspects have been remanded.
“JPN Kedah is giving its full cooperation to the ongoing investigation,” it said in a statement on Thursday (Oct 16).
The department added that an internal probe had also been launched, resulting in the expulsion of the offenders.
“The Education Ministry does not compromise on any form of sexual misconduct in educational institutions and is continuously working to improve all aspects to ensure the safety and well-being of the education community,” it added.
Earlier today, it was reported that four teenagers, including three students, were arrested by police for allegedly being involved in a gang rape of a girl and distributing pornographic material on social media.
Baling acting OCPD Deputy Supt Ahmad Salimi Mat Ali said police received a report from a woman on Sunday at about 11am after being informed by a disciplinary teacher about the circulation of a nude video clip of her daughter.
Following the report, police detained three students and a former student of the school on the same day at about 9.30pm to assist the investigation.
It was learnt that the suspects were allegedly involved in sexual acts in several classes at the school between May and August. - Star, 16/10/2025
