Why did Malaysia reject spouse visa applications of 10,000 plus Malaysians who had a foreigner husband/wife? Was the Marriage illegal? Is this DISCRIMINATION?

Home Minister Saifuddin Nasution Ismail must explain WHY the application of 48 percent of 23,674 application for a foreign spouse married to Malaysian citizens for a foreign spouse visa was rejected? This means the foreign spouses cannot remain in Malaysia - but most probably have to leave Malaysia every 30 days(the duration of Malaysian social visit pass) and re-enter repeatedly to be with the Malaysian husband/wife?

“This is a significant step forward. With this timeframe, it will ease the application process for Malaysians married to foreign nationals, allowing them to stay in the country without complex bureaucracy,” he said. From 2020 to 2024, a total of 23,674 applications were processed, with 52 per cent approved and 48 per cent rejected, Saifuddin Nasution added.

In my view, once the marriage of a Malaysian with a foreigner husband/wife has been registered in Malaysia - the foreign spouse best be accorded Permanent Resident(PR) status so long as the marriage subsists. In the event of divorce, then the PR status may be reviewed, and may be allowed to continue depending on various factors - the existence of Malaysian children from the marriage, and any other factors... If not a PR Status, then a long term 'Spouse Visa' at the very least.

A 6 month period to process the application is ABSURD - does this mean that the foreign spouse have to leave Malaysia before 30 days(noting that the social visit visa is for 30 days), and re-enter Malaysia for another 30 days, leave and return again repeatedly - before an application for a SPOUSE VISA (that Minister takes about 6 months to process). Or is the Minister suggesting that the foreign spouse stay out of Malaysia for 6 months or more..before entering Malaysia...

Does Malaysia not recognize the institution of Marriage, and the need for married couple to stay together? Malaysia or the Minister certainly do not want to to be the cause of breaking up marriages..

It was shocking to hear that Malaysia REJECTED about 10,000 plus applications...WHY? WHY? The reason for rejection is VERY VERY Important? Hopefully, it is not because of some time of discrimination -- that will be very disappointing.

Anyway, if the government requires 6 months or more, then reasonably an interim spouse visa must be issued for 6 or 8 or 12 months to enable the making of needed applications, the time the government processes and decides on the application, time for appeal and appeal decision, etc. 

Foreign Spouses of Malaysians are not to be treated like applications of foreigners to work in Malaysia, to study in Malaysia, or to do business in Malaysia...

This is about FAMILY VALUES - and it should be expedited. When the marriage is registered in Malaysia - they are married legally, and the government really then has no reason to DENY a spouse VISA, or a PR Status by reason of marriage to a Malaysian.

 

Why some got citizenship? some PR status? and others still on 'social visit visa'? Was there discrimination when dealing with foreign spouses?

KULIM, Jan 25 — The processing time for entry permit applications has been improved to a maximum of six months, provided all required documents are submitted in full.

Home Minister Datuk Seri Saifuddin Nasution Ismail said the new process prioritises applications from Malaysian citizens married to foreign nationals.

“An entry permit is a document that allows foreign nationals to enter and reside in Malaysia for purposes such as studying or joining family members. Previously, some applications were delayed for up to 15 years.

“The new process now follows a more realistic client charter. Applications will be approved within six months if they pass the standard document verification and security screening,” he told reporters at the Home Ministry’s ‘Sua Mesra’ programme at Sekolah Kebangsaan Sungai Karangan here today.

Saifuddin Nasution said new standard operating procedures (SOPs) have been introduced to guide applicants clearly, including a comprehensive document checklist and application guidelines.

“This is a significant step forward. With this timeframe, it will ease the application process for Malaysians married to foreign nationals, allowing them to stay in the country without complex bureaucracy,” he said.

From 2020 to 2024, a total of 23,674 applications were processed, with 52 per cent approved and 48 per cent rejected, Saifuddin Nasution added.

Meanwhile, on the issue of Bukit Malut in Langkawi, Saifuddin Nasution said the matter is currently under the purview of the National Security Council (MKN).

“A joint committee comprising MKN and the Kedah government is currently discussing the best resolution,” he said.

Recently, Kedah Menteri Besar Datuk Seri Muhammad Sanusi Md Nor urged MKN to expedite the relocation process for Bukit Malut residents.

He was reported as saying that the state government hopes the planned project will be implemented promptly to end the ongoing controversy, including the widespread illegal construction of houses extending into nearby coastal areas. — Bernama, Malay Mail, 25/1/2025
