18 bekas pekerja anak syarikat DRB Hicom, tidak berjaya mendapat kerja kembali, yang merupakan tuntutan mereka berasaskan dakwaan 'pembuangan kerja secara salah' - ini adalah satu kekalahan kepada pekerja dan kesatuan sekerja.Mahkamah, secara adil, harus memberikan mereka kerja kembali. [Jika dapat kerja kembali, pekerja itu bukan sahaja akan dapat gaji/elaun/bonus mulai tarikh pembuangan kerja sehingga mereka masuk kerja kembali - tetapi mereka juga akan mendapat kerja mereka kembali.]
Pimpinan kesatuan sekerja - ya, mereka yang dibuang kerja adalah pemimpin dan ahli kesatuan sekerja yang aktif dan berani berjuang untuk hak dan kebaikkan pekerja. Melalui pembuangan kerja, dan Mahkamah tidak mendapatkan kembali pekerja ini, majikan berjaya menyingkirkan kepimipinan dan pekerja yang berani berjuang...Tindakan ini juga akan bekemungkinan 'menakutkan' pekerja lain - akan timbul takut berjuang. Adakah kerajaan Pakatan Harapan yang baru mahu hakikat sebegini berterusan?
RM1.1 juta yang dianugerahkan Mahkamah bukan besar...ianya sangat rendah bagi pekerja yang telah dibuang kerja secara salah(yang Mahkamah mengiktirafkan) sejak lebih kurang 19/8/2013 - iaitu lebih 5 tahun yang lepas(lebih kurang 63 bulan lepas) - jadi apa yang mereka terima adalah hanya lebih kurang RM970-00 sebulan, kalau dikirakan semua dapat sama rata.LANGSUNG TAK ADIL.

Jangan lupa kerajaan UMNO-BN, telah meminda Akta dan menetapkan maksima yang Mahkamah boleh berikan hanya 24 bulan gaji...sebelum itu, bila Mahkamah putuskan pembuangan kerja salah, pekerja berhak mendapat semua gaji/elaun/bonus mulai tarikh pemberhentian sehingga tarikh kembali kerja(atau tarikh perintah Mahkamah).
YA, majikan didapati membuang kerja dengan salah...kenapa pula kerajaan UMNO-BN menolong majikan? Adakah kerajaan Pakatan Harapan akan sama? Jangan LUPA pekerja ada lebih banyak UNDI daripada mereka yang menjadi MAJIKAN.
INDONESIA mempunyai cara yang lebih baik. Bila pekerja mendakwa pembuangan kerja secara salah oleh majikan, majikan terus terpaksa mengaji pekerja dan memberi kerja, dan pekerja termasuk masuk kerja saperti biasa sehingga proses(termasuk Mahkamah) memutuskan sama ada pekerja telah dibuang kerja dengan sah atau tidak. INI LEBIH ADIL. Sekiranya majikan tidak mahu pekerja kembali kerja, majikan terpaksa terus membayar setiap bulan gaji/elaun/bonus saperti biasa sehingga Mahkamah menentukan sama ada pekerja dibuang kerja atau tidak. Ini bagus kerana majikan tidak akan melenggahkan proses ..dan Undang-undang juga menetapkan had masa kes diselesaikan - lebih kurang 150 hari untuk semua termasuk rayuan diselesaikan.

Kini untuk 18 pekerja, yang dibuang kerja secara salah, lebih 5 tahun sudah berlalu...
Harap kerajaan baru Pakatan Harapan segera meminda undang-undang supaya lebih adil bagi semua, terutama pekerja.
Jangan lupa dalam kebanyakkan kes pembuangan kerja, pekerja juga terpaksa keluarkan wang sendiri untuk mendapat perkhidmatan peguam. [Ramai yang masih tidak sedar bahawa Pusat Bantuan Guaman Majlis Peguam sedia mengambil kes pekerja, di mana maksima kena bayar pun hanya lebih kurang RM250 saja]
Kerajaan Pakatan Harapan boleh juga menyediakan bantuan guaman untuk Pekerja...
Kos perjuangan dapatkan keadilan ini menyebabkan ramai pekerja yang dibuang kerja secara salah TAK pergi menuntut kerja kembali dan keadilan. Kos perjuangan mendapatkan hak lain juga menyebabkan ramai tidak mampu ...justeru benarkan majikan yang melakukan ketidakadilan lepas gitu saja. Yang paling menyedihkan adalah bawa Wakil Kesatuan Sekerja pun mengenakan bayaran, yang kena dibayar pekerja itu sendiri. [Bagi kes buang kerja secara salah, kini ada Wakil Kesatuan yang mengenakan caj RM5,000-RM10,000...] Ini sangat menyedihkan, Kesatuan yang patut membantu pekerja juga mengaut keuntungan dari pekerja mangsa ketidakadilan majikan???

Court awards RM1.1 mil to 18 ex-workers of DRB-Hicom subsidiaries
PETALING
JAYA: The Industrial Court has awarded about RM1.1 million in backdated
wages and compensation in lieu of reinstatement to 18 ex-employees of
two auto parts manufacturing companies although they were found guilty
of misconduct.
Industrial Court chairman Mohd Dusuki Mokhtar found that the punishment of dismissal was too severe.
It was revealed that the managements of Hicom Automotive
Manufacturers (M) Sdn Bhd and Izuzu Hicom (M) Sdn Bhd had discovered a
video recording that was uploaded on YouTube and which they said had the
potential to affect the reputation of the companies.
Both companies are subsidiaries of DRB-Hicom Group based in Pekan, Pahang.
The recording revealed that the 18 claimants had on May 3, 2013,
attended a workers’ manifesto handing-over ceremony to a PAS candidate
who was contesting the Peramu Jaya state seat within the Pekan
parliamentary seat in the 2013 general election.
Some of the 17 claimants were wearing work uniforms with logos of
their companies. The 18th worker was accused of leading the group in
handing over the memorandum to the candidate.
The managements, which were unhappy with the workers’ explanations,
then conducted a domestic inquiry before dismissing them on Aug 19,
2013.
They were charged with affecting the image of their companies and
using outside influence to meet their industrial demand for higher wages
and a better work environment.
Dusuki said the employers had proven their cases on the balance of
probabilities but it did not warrant dismissal from employment.
“The court is entitled to substitute the punishment which it finds to
be disproportionate to the misconduct,” he said in the 60-page award
made available yesterday.
He said the court had also weighed the interests of the employees and employers before coming to a decision.
The court also noted that the workers had earlier attended an event
organised by Rosmah Mansor, the wife of then prime minister and current
Pekan MP Najib Razak, at their residence in Pekan.
Dusuki said dismissal was not appropriate after taking into account
that most of the workers had served their employers for 20 years.
“Evidence also showed they had no past record of serious indiscipline
with their employers,” he said, adding the misconduct was also not
criminal in nature.
He said the workers had not criticised the then ruling federal
government, Barisan Nasional or promoted Pakatan Rakyat in demanding
their rights.
PAS was part of the loose PR opposition coalition in the 13th general election.
The workers will be receiving between RM24,000 and RM94,000 each in backdated wages and compensation in lieu of reinstatement.
Dusuki said sending them to work with their previous employers was not feasible in the interest of industrial harmony.
Lawyer R Chandra Segaran appeared for the workers while N Sivabalah and Raymond T C Low appeared for the companies.- FMT News, 13/10/2018
