LIES - police kills a person with 14 prior criminal records?. So, was there 14 times that he was arrested, charged in court for a crime, tried, found guilty, convicted and sentenced?
Zahid Hamidi was charged for 47 criminal offences, and in the VLN case, he was charged for 40 criminal offences in the VLN case - does he have 87 prior criminal records? No, he does not because he was not tried and found guilty for the 87 criminal charges for which he was alleged to have committed.
On the other hand, Anwar Ibrahim was found guilty for 4 'corruption' charges, and then guilty for sodomy - so, he has 5 criminal records.
So, if the 63 year old man was not tried and found guilty, it is most MISLEADING to say that he has '14 prior criminal records'...
REMEMBER the presumption of innocence until proven guilty -
Article 11(1) Universal Declaration of Human Rights - Everyone charged with a penal offence has the right to be presumed innocent until proved guilty according to law in a public trial at which he has had all the guarantees necessary for his defence.
So, police please tells us what you mean by criminal record - is it different from legal definition? Does it mean the number of times a person is called in for investigation...OR is it just 'made up' without the deceased even suspecting that the police suspected him/her of a crime
Can a dead person be investigated, charged and tried for a criminal offence? NO - he cannot.
The case is being investigated under Section 307 of the Penal Code for attempted murder and Section 3 of the Firearms Act.So, is this INVESTIGATION of the deceased, an EFFORT by police to prove that he indeed was a BAD man who deserves to be shot DEAD - This is so wrong....the people who the police must be investigating now are the POLICE OFFICERS that were involved in the killing of the 63 year old man, riding a motorbike??
Remember, the ONLY TIME the law allows police to KILL is if and when the ACCUSSED(means already charged in COURT) of a
Section 15 Arrest, how made (Criminal Procedure Code)(1) In making an arrest the police officer or other person making the same shall actually touch or confine the body of the person to be arrested unless there is a submission to the custody by word or action.
(2) If such person forcibly resist the endeavour to arrest him or attempt to evade the arrest such officer or other person may use all means necessary to effect the arrest.
(3) Nothing in this section gives a right to cause the death of a person who is not accused of an offence punishable with death or with imprisonment for a term of not less than thirty years but not exceeding forty years or with imprisonment for life.
So, naturally, in this case - it is the police that have committed a crime - AN EXTRAJUDICIAL KILLING, and thus they must be Charged in Court for MURDER, Culpable Homicide or some other killing offences. INVESTIGATE the police officers now - and SUSPEND them pending completion of investigation. In Court, the said police 'suspected criminals' will have to proof their innocence (most difficult in this case), or whatever DEFENCE they may have - like maybe 'self-defence',...Court will decide on Guilt and sentence...
In such cases, where people DIE whilst being arrested - the Inspector General of Police or other police chiefs should come out and APOLOGIZE for the death to the family/dependents/friends of the Deceased, and assuring that police who caused the death will be thoroughly investigated..
Same too must be the RESPONSE of Saifuddin Nasution, the Home Minister who is responsible for the police...APOLOGY and offer condolence
BUT, where is the APOLOGY and condolence from the Minister and police - absent after the police shot him dead. It is sad that Malaysian police comes out trying to JUSTIFY THE KILLING, whilst hiding some facts..
How many police officers were involved in the gunning down of this Senior Citizen? The police says ...'officers from the Special Investigation Unit (D9) chanced upon the man while conducting a patrol.' - well, no mention about the NUMBER of police officers involved was it 6 or 10 or more who shot dead a lone suspect on a motorbike...
These patrols of 'the Special Investigation Unit (D9)' do not normally do a random patrol in areas - that is done by car patrol units(2 persons) or some motorbike patrol unit. Was it really a 'chance encounter' or were they out there looking to arrest(hopefully not KILL) the now deceased suspect.
When police officers move out of the station - they usually act on ORDERS - so what was the ORDERS of this D9 police unit on that day? Were they following orders - or were they on a FROLIC of their own...'PONTENG KERJA"
Why do suspected criminals get killed by police in other jurisdictions? Well, it could be that certain parties simply cannot risk the arrest of a LIVE suspect - who may disclose information about the Kingpin, other police officers who 'protected them' because of some bribe, the involvement of some politician or government officer/Minister, etc... so, whenever an alleged suspect is SHOT dead rather than be arrested - or shot and arrested, DOUBTS arise as to WHY he/she was killed? The Wang Kelian incident was also suspicious - when the IGP 'temporarily stopped investigations", evidence destroyed not speedily collected and preserved...
Remember that even in the Murder of Mongolian Altantuya, there was 'allegations' that the 2 police officers convicted for MURDER were acting on ORDERS of another. Time to CRIMINALIZE persons who ordered the killing of another, or those who paid another to KILL someone. Police must always investigate whether the murderer was acting under ORDERS or a contract to kill?
Were the police officers from D9 ordered to find this man and kill him - was there orders from the head of D9? IGP? or some Minister?..
Sadly, in Malaysia, in most shoot and kill by police incidents, ALL suspects end up dead - no one remains alive and get arrested. 298 persons shot to death by police since 2007 - Demand public inquiry for every case
Prime Minister Anwar Ibrahim must pay attention on these EXTRAJUDICIAL KILLINGS in Malaysia, and the reality that police killers are out there SCOT FREE ... At least, have the courtesy to APOLOGIZE and offer condolences ...after all the dead are also Malaysians, possibly with a family and children/grandchildren.
INVESTIGATE the PERPETRATOR not the DEAD...
If we had the Independent Police Complaints and Misconduct Commission (IPCMC) with the powers to not just investigate Police Misconduct BUT also Police Crimes, with the ability to also Prosecute themselves , Malaysia would have had the needed body to do justice where the criminals may be police. But sadly, it was Prime Minister Anwar Ibrahim's government who 'killed' the IPCMC - when the Anwar's Home Minister Nasution put into force on 1/7/2023 the Independent Police Conduct Commission Act 2022. The right thing that Anwar should have done was to re-table the IPCMC Bill, and repeal the IPCC Act.
The IPCC is nothing short of a 'SORTING COMMISSION" - it decides which complaint is to be referred to the police/MACC/etc to be investigated as a crime, and which is a misconduct to be referred to the Police Commission or disciplinary board. The IPCC does not do its own inquiry/investigation and comes out with a finding(with also recommendation that police be charged for crimes). Even before the Royal Commission of Inquiry in 2005 recommended the formation of the IPCMC - all these mechanism to investigate crimes and/or misconduct by police existed but the RCI decided it was NOT ENOUGH - that's why it proposed an IPCMC. But, Anwar took us back to square one, the situation as it was before 2005...
The government can still re-introduce the IPCMC - where the stress was for an INDEPENDENT Commission that will investigate and prosecute crimes/misconduct by police..
The IPCC 2022 Act removed the Enforcement Agency Integrity Commission(EAIC)'s jurisdiction to deal with complaints about police. The EAIC did OK and it had its own inquiry and reported its findings to the public in also several death in police custody cases , where in some it found the police criminally liable and recommended prosecution.
What has the IPCC done to date - we hear almost nothing at all - but then all it can say is that bit referred this case to the police or MACC or relevant law enforcement or to this disciplinary post. WE do not need to waste money on such a commission, this is a JOB that an ordinary clerk can do...
The minister said the IPCC has received 529 complaints so far. Cases involving abuse of power or corruption are referred to the Malaysian Anti-Corruption Commission (MACC), while criminal matters are handed over to the police, with complaints categorised based on jurisdiction.BRING BACK the IPCMC - The earlier PH government after GE14 is so much better, than Anwar Ibrahim's PH-led government after GE15. The way this PH-led government is functioning, it will not be a surprise that Malaysians may end up REJECTING PH come GE16...

Johor police kill aged fugitive with 14 prior criminal records in shoot-out

JOHOR BARU, March 8 — A 63-year-old fugitive was shot dead in an exchange of gunfire with police at Jalan Persiaran Bumi Hijau, Taman Molek, Johor Baru, earlier today.
According to Johor Police Chief Datuk M. Kumar, the incident occurred around 3.10am when officers from the Special Investigation Unit (D9) chanced upon the man while conducting a patrol.
“The suspect suddenly fired several shots at the police raid team, forcing officers to return fire in self-defence,” said
Police recovered a Smith & Wesson pistol, four live bullets, and two spent shell casings from the scene.
A background check revealed the suspect had 14 prior criminal and drug-related records, including outstanding arrest warrants.
He also had previous offences under the Firearms (Increased Penalties) Act 1971 and the Arms Act 1960.
The case is being investigated under Section 307 of the Penal Code for attempted murder and Section 3 of the Firearms Act.
