2 workers buried alive while working - Murder? Governmnent Failure? Industrial Manslaughter Laws?

2 workers buried alive, yet again in a similar kind of accident that has happened so many times before. Surely, there should have been regulations/laws in place to ensure that no workers die in such a situation.
 
In the recent event, apparently the excavators were still working ...surely 
“Both victims and the third worker are believed to have been inside a six metre-deep pit, while two machines were excavating earth on the ground above the pit.

Heaps of soil which had collected at the edge of the pit then began falling during the excavation works, burying the two workers,” said Temerloh district police chief Assistant Commissioner Mohd Yusri Othman.
So, should not the excavator operators be charged for murder...maybe also the officer in charge of the construction site, the manager, supervisors,....and the construction company Directors as well. Charge them all for murder ... 

The employer asked the workers to get into that hole in dangerous life threatening situation...and they died. 

Could they have not stopped other machines, including excavators, working, knowing that vibration can cause soil to fall back and bury the workers alive? 

Could not some blockades be built to prevent the soil from falling back into the hole and burying workers..

How did the police classify this deaths? - 'Sudden Death'?  Murder or some other penal code killing offences?

Was there any investigations conducted yet? Most likely, the responsibility of the death should fall on the supervisor, managers, excavator drivers... 

INQUEST - Will there be an inquiry into this death? After all the coroner also decides whether there is anyone criminally liable for the deaths...

Is SAFE WORKING ENVIRONMENT not the priority in modern Malaysia? 

OR maybe the government and the authorities are not bothered for after all the victims are just some workers...not some Datuk or some prominent person?

Let us just look at the some of the past reported cases, that are shockingly similar 

5/10/2015 -  An Indonesian worker died after he was buried in a three-metre drain during excavation works 

30/9/2019 -  Bangladeshi construction worker was killed after he was buried in a pile of soil...earlier dug a hole about three-meters deep to install underground pipes. However, the soils collapsed onto them causing both to be buried.

30/3/2015 -  Two construction workers were killed when earth collapsed and buried them in the hole...the victims in the 2pm incident were a local man and a Myanmar national...for water supply pipe project..
Our Media sadly seldom reports industrial incidents that causes death or injury to workers ... 

Just look at the media reports, the simply do not name the Construction company or the contractor responsible for these construction projects...WHY? To protect these Companies or maybe the Directors and owners are politically connected? 

Will the media even follow up to ensure justice is done ...after all these are human beings, possibly with family and children...They are someone's child, brother, father... 

If it was a SAFE WORKPLACE, no one will be dying ...

Will this company or contractor be 'blacklisted' - or nothing happens, and few more workers may die later in their worksites and/or construction projects..

KUANTAN: Two foreign workers were killed when they were buried by mounds of falling earth at a housing project construction site in Mentakab, Temerloh near here, yesterday.

The dead were identified as Bangladeshi nationals Md Shoriful, 43, and Julhas Rahman, 27.

The two men were among three workers who were carrying out sewage pipe installation works when the accident occurred at 4.15pm.

“Both victims and the third worker are believed to have been inside a six metre-deep pit, while two machines were excavating earth on the ground above the pit.

“Heaps of soil which had collected at the edge of the pit then began falling during the excavation works, burying the two workers,” said Temerloh district police chief Assistant Commissioner Mohd Yusri Othman.

One of the three workers was pulled out safely, while efforts to save the other two failed.

Mohd Yusri said Fire and Rescue Department personnel extricated Shoriful’s body at 4.45pm, while the body of Julhas was retrieved 15 minutes later. – BERNAMA - New Straits Times, 6/3/2020

SHAH ALAM: An Indonesian worker died after he was buried in a three-metre drain during excavation works at Jalan Parang 19/8 in Seksyen 19, here, this morning.

In the 10.30am incident, the worker, known as Jalmi was found lifeless by the Fire and Rescue Department team despatched to the location.

“We received a call about the incident at 10.27am and reached the location at 10.34am.

“The victim, an Indonesian worker known as Jalmi, who was in his 20s, died in the incident.

“His body was taken to the Tengku Ampuan Rahimah Hospital (HTAR) for post mortem,” said Selangor Fire and Rescue Department assistant director (operations) Mohd Sani Harul when contacted - New Straits Times, 5/10/2019

Construction worker buried while installing underground pipes


KUALA LUMPUR: A Bangladeshi construction worker was killed after he was buried in a pile of soil near the junction of Jalan Jelatek, here this afternoon.

It is learnt that the victim and his colleague had earlier dug a hole about three-meters deep to install underground pipes.

However, the soils collapsed onto them causing both to be buried.

City Fire and Rescue Department chief operations officer Samsol Maarif Saibani said two fire engines and 12 firemen from Keramat and Wangsa Maju fire stations were deployed to the scene at 11.49am.

"The firemen took about two hours to dig the ground using a hoe in order to locate and rescue the victims.

"At first, we used a bulldozer but as soon as we saw the victim's head, we started to use a hoe as we fear injuring their bodies," he said.

Samsol said the fireman managed to extricate both victims but one had died from breathing complications.

The body, he said, was sent to Kuala Lumpur Hospital for post-mortem.

Another victim who was involved in the incident escaped with injuries, said Samsol. - New Straits Times, 30/9/2015
 

Construction workers buried alive

MACHANG: Two construction workers were killed when earth collapsed and buried them in the hole they were digging in Pulai Chondong here.

A spokesman from the District Fire and Rescue station said the victims in the 2pm incident were a local man and a Myanmar national.

"The victims were digging the hole for water supply pipe project," he said.

The spokesman said the bodies of the victims had been recovered by firemen and sent to the hospital for a post mortem shortly after 3pm.

However, he said the identities of the victims had yet to be established. - New Straits Times, 30/3/2020
