Badul's son, Mejar Mohd Zahir shot dead in a demonstration? Live bullets? Faulty Vests? - INQUEST and criminal action?

Adib - Inkues kematian telah siap...kini kina perlu menuntut inkues kematian untuk Mejar Mohd Zahir Armaya? Mengapa ramai(termasuk media massa minat dengan inkues Adib - tetapi kurang berminat untuk inkues untuk semua yang mati ditembak polis, mati dalam tahanan polis, mati dalam demonstrasi angkatan tentera....???

Adib's inquest done ...a similar concern level needed for inquests for all deaths - including those shot dead by police, those who died in custody, those who were killed in military actions/demonstrations, ...and all other deaths...our law says inquests need be done for all deaths, does it not?

Major Mohd Zahir, 36, a commando of the 11th Special Forces Regiment, died on Wednesday after being shot during a demonstration in conjunction with the launch of the 5th Infantry Division and the 13th Infantry Brigade. 

Why was live bullets used during a demonstration? Why was a Major involved in the exercise? Did he have a bullet proof vest on - or was it of a proper quality? Was there corruption involved in the acquisition ...which ended up in sub-standard vests?

Killing someone negligently is also a CRIME - and the suspected criminals could be charged in court. 

The Army’s investigation board will take disciplinary action against those involved in the death of a commando, Major Mohd Zahir Armaya, during a demonstration exercise on Sept 4. Defence Minister Mohamad Sabu also said the ministry would take to the higher level a request by Zahir’s family for an inquest to find the cause of death.
Is Mat Sabu just looking at 'disciplinary action' - there should be a criminal investigation, and those criminally liable for the death must be charged in court. 

Minister talking about taking to 'the higher level' before an inquest is conducted - Is it the YDP Agung that he is talking about? Surely the Minister, the PM and/or the King have no power to decide whether an inquest is conducted or not - there should be an INQUEST for Mejar Mohd Zahir Armaya


Inquests, after all, must be conducted in all cases, except in the limited exceptions provided for in law.


Section 333 of the Criminal Procedure Code states, ’(1) If the Magistrate shall be satisfied as to the cause of death without holding an inquiry under this Chapter, he shall report to the Public Prosecutor the cause of death as ascertained to his satisfaction with his reasons for being so satisfied and shall at the same time transmit to the Public Prosecutor all reports and documents in his possession connected with the matter. (2) In all other cases the Magistrate shall proceed as soon as may be to hold an inquiry under this Chapter.’


It must be pointed out that the word "cause of death" in the law is defined to ‘… include not only the apparent cause of death as ascertainable by inspection or post-mortem examination of the body of the deceased, but also all matters necessary to enable an opinion to be formed as to the manner in which the deceased came by his death and as to whether his death resulted in any way from, or was accelerated by, any unlawful act or omission on the part of any other person…’- Inquest for all Police Shot Dead Victims - Extrajudicial Killing Must Be Criminalized in Malaysia

Saya mahu inkues kematian anak saya - AR Badul

SENIMAN AR Badul mahu satu inkues dijalankan terhadap kematian anaknya, Mejar Mohd Zahir Armaya bagi mengetahui punca sebenar kematian pegawai komando itu.

Badul atau nama sebenarnya Armaya Aman Ramlie, 70, menyifatkan penjelasan diberikan Tentera Darat Malaysia (TDM) berhubung siasatan kematian anaknya terlalu ringkas dan tidak menyeluruh.

“Saya bapa Mohd Zahir. Sudah pasti saya mahukan penjelasan yang lebih terperinci dan bukannya daripada media massa.



“Pihak berkuasa ada nombor telefon saya dan mereka boleh hubungi saya untuk menerangkan apa yang menyebabkan anak saya maut, namun tiada seorang pun yang berbuat demikian...saya sangat hampa.

“Kalau boleh saya mahukan inkues, sama seperti yang dijalankan terhadap kes anggota bomba, Allahyarham Muhammad Adib Mohd Kassim.

“Saya mahu mengetahui punca sebenar dan kronologi bagaimana anak saya boleh maut dan apakah usaha menyelamatkannya selepas arwah ditembak,” katanya.

Dia berkata demikian selepas majlis tahlil untuk arwah anaknya di Seksyen 28, Shah Alam, hari ini.

Katanya, tiada penjelasan daripada pihak berkuasa sama ada baju kalis peluru itu mengikut spesifikasi ditetapkan atau sebaliknya.

“Ramai hubungi saya untuk memperjuangkan nasib arwah anak, namun saya tidak mahu mengeruhkan keadaan memadai dengan penjelasan terperinci mengenai kejadian itu.

“Bukan saya dan keluarga saja yang mahukan penjelasan, tetapi rakyat Malaysia yang mengikuti perkembangan kes ini. Mereka juga berhak mengetahui perkara sebenar,” katanya.

Terdahulu, TDM dalam satu kenyataan, hari ini, mengklasifikasikan insiden kematian pegawai komando terkena tembakan dalam aksi demonstrasi di Kem Lok Kawi, Sabah, 4 September lalu, sebagai kejadian terpencil dan kemalangan dalam latihan.

TDM juga mengemas kini prosedur operasi standard (SOP) mengikut keperluan selain latihan memperkasakan TDM akan diteruskan khususnya bagi meningkatkan keyakinan terhadap peralatan dan kelengkapan sedia ada.- Harian Metro, 26/9/2019

Armed forces respects family's call for inquest into Maj Mohd Zahir's death

The Malaysian Armed Forces (MAF) respects veteran actor-comedian AR Badul's call for an inquest into the death of his son, Major Mohd Zahir Armaya, 36,  during a demonstration exercise early this month.

MAF chief Gen Zulkifli Zainal Abidin said today that Badul (formally known as Armaya Aman Ramlie) had a personal right to make such a request.

"We have to respect whatever he requests," Zulkifli said, explaining that all matters concerning the incident had yet to be completed.

Once this was done and a final decision was reached, Mohd Zahir's family would be provided with a detailed briefing, he said.

Zulkifli added that constant contact had been made with the family, with visits conducted almost every day.


He was speaking at a press conference after officiating at the 86th MAF parade held at the Royal Malaysian Navy base in Lumut.

Last night, after attending a tahlil ceremony for Mohd Zahir, Badul told reporters that his family will request for an inquest similar to that conducted for deceased fireman Muhammad Adib Mohd Kassim.

He said the investigation would give all family members an understanding of the true chronology of events concerning the death.

The Malaysian army yesterday confirmed that Mohd Zahir's death was accidental, having occurred during training, while an army investigating board had classified it as an isolated incident.

Mohd Zahir was killed in a shooting demonstration turned tragic on Sept 4, at the Lok Kawi army camp in Sabah.

He was attached to the commando unit based at the Sungai Udang army camp in Malacca.

Mohd Zahir is survived by a widow and five children aged between five months and nine.

KUALA LUMPUR: The Army’s investigation board will take disciplinary action against those involved in the death of a commando, Major Mohd Zahir Armaya, during a demonstration exercise on Sept 4.

Defence Minister Mohamad Sabu also said the ministry would take to the higher level a request by Zahir’s family for an inquest to find the cause of death.

The ministry would also update standard procedures on training if required.

“The defence ministry also supported the late Mohd Zahir’s posthumous promotion to Lieutenant Colonel as decided during the 578th Armed Forces Council which convened on Sept 17, subject to the approval of the Yang di-Pertuan Agong ” he said in a statement today.
Mohamad, who is better known as Mat Sabu, added that he was informed by the army’s investigation board that the incident was an isolated case and classified as a training accident.

Cops believe negligence caused Major Zahir's death

KUALA LUMPUR: The investigation into the death of Major Mohd Zahir Armaya, who was killed in a shooting demonstration at Lok Kawi Camp in Kota Kinabalu on Wednesday, is leading towards negligence as the cause of the tragedy.

Sabah Police Commissioner Datuk Omar Mammah said the case is being investigated under Section 304A of the Penal Code, and that several individuals will be called in to assist the investigation.

“So far, investigations appear to lead to negligence, but further investigations will be carried out,” he added.

Omar said 11 individuals, including members of the military involved in the shooting incident, have already been called to provide their statements.

On Thursday, Inspector-General of Police Tan Sri Abdul Hamid Bador said that the Royal Malaysia Police is conducting a full probe of the incident.
