In law, if the Immigration Department makes a decision, and you are unsatisfied with that decision, you must appeal to the Home Minister > But what if the Home Minister stays silent and does not give a decision on your APPEAL - mind you, the law says that you must first appeal to the Home Minister - this means you cannot go for JUDICIAL REVIEW, where we ask the Courts to look and decide on the decision made by the Minister/government. In this case, because the Home Minister fails to decide on your appeal - you are stucked and cannot proceed to court for a Judicial Review - your rights are VIOLATED.
If not waiting for the Minister's decision on your appeal, you go to court for a Judicial Review - the Court will strike out your application, first complete the procedure set out in law, i.e. first appeal to the Minister, and if still dissatisfied with the Minister's appeal decision, then only you can file a Judicial Review in Court..
So, what about a Home Minister that just simply IGNORES and delay(or do not consider the appeal and make a decision), then this Minister is a BAD MINISTER...
Well, Hamzah Zainuddin is as such a bad HOME MINISTER - that is why we need competent/good MPs or Senators that should be the Minister..
The Prime Minister must chose good Ministers > not simply make anyone a Minister, because this or that party wanted so many Ministerial positions.
GE15: Hamzah: 'Cruel to choose leaders with no integrity'
PUTRAJAYA: Integrity is an important characteristic that a leader must possess to bring prosperity to the country.
Caretaker Home Minister Datuk Seri Hamzah Zainudin said it would be hard to argue against a leader when he or she was "clean" and free of any wrongdoings.
He pointed out that in Islamic history, when a person with good characteristics was chosen as a leader, that person would be able to bring development to a country.
"If the country is a developed country, the selection of leaders, who are proven to be good, will make the country an example to be followed by the rest of the world," he said after attending the monthly assembly of the Immigration Department here earlier today.
Hamzah said it was cruel of voters to elect a leader who lied, and a leader who committed acts which caused the country to languish in poverty.
He cited a verse in the Quran, in which Islam forbade the act of unlawfully accruing and accumulating wealth.
Hamzah, who is Parti Pribumi Bersatu Malaysia (Bersatu) secretary-general, said Malaysia could once again become an Asian tiger if all quarters chose leaders who were trustworthy, and capable of charting a path towards a better future.
He said one of the world's best known billionaires, Warren Buffet, had also highlighted factors that people should consider when evaluating a person.
"Warren Buffet said that when one evaluates a person, one must look at the person's intelligence, energy and integrity.
"And he also stressed that when integrity is non-existent, there is no need to look at the other two factors because they would no longer matter."
Hamzah said it was useless if someone has intelligence and energy, but lacked integrity.
"What I say is something all of us should think about. I apologise, I
have never spoken like this, but during such times, I have to speak as
such as I am a patriot who loves my country," he said. - NST, 11/11/2022
MINISTERS - should we have a process of 'Examination' to determine whether so and so should be appointed as a Minister - or maybe the Minister of Home Affairs. Placing a 'fool' or a person not up to task and responsibility of a Minister(or even a Deputy Minister) will result in an embarrassment to the Prime Minister or the government of the day.
