1MDB? GLCs? WHAT CAN BE DONE by Federal/State governments to avoid 'kelptocracy' and abuses?

1MDB...many Malaysians believe that there have been wrongdoings despite the fact that the government still denies - the important question now is what should be done now to prevent similar wrongdoings happening in the future with regard to government owned companies and/or GLCs 
 
1MDB...kebanyakkan rakyat Malaysia percaya bahawa salahlaku telah berlaku walaupun kerajaan kita masih kata tidak...Persoalan utama kini adalah apa yang patut buat untuk mengelakkan perkara sama berlaku pada masa hadapan dengan syarikat milik kerajaan dan/atau GLC...

Privatization and Corporatization is a means to avoid Accountability and Transparency by the Government...both Federal and State governments...

Pengswastaan dan pengkorporatan adalah cara bagaimana mengelakkan keperluan Accountability dan Transparency oleh kerajaan - bukan sahaja kerajaan Persekutuan tetapi juga kerajaan Negeri ...

AUDITOR GENERAL - well, as of right, he only audits government - the Ministries, Departments and Government Agencies - Not Private Companies or Corporatizations. The government, however, can ask for audits to be done for such companies - but then, they can keep those audits 'secret' as is happening with the IMDB Audits.

Auditor General - berasaskan undang-undang kini, beliau hanya DIWAJIBKAN audit kerajaan - Kementerian, Jabatan dan Agensi Kerajaan - Bukan Syarikat Swasta. Kerajaan boleh meminta Auditor General membuat audit syarikat sedemikian tetapi selepas itu, kerajaan boleh merahsiakan audit itu - saperti yang masih dilakukan Audit 1MDB.

106  Powers and duties of Auditor General.

(1) The accounts of the Federation and of the States shall be audited and reported on by the Auditor General.
(2) The Auditor General shall perform such other duties and exercise such powers in relation to the accounts of the Federation and of the States and to the accounts of other public authorities and of those bodies which are specified by order made by the Yang di- Pertuan Agong, as may be provided by federal law.

So, you see the private companies, even if they are wholly owned or partially owned by government may not be audited by the Auditor General...as they are not clearly 'accounts of the Federation and of the States', as they are seen as private companies and corporations. Likewise the are not 'public authorities' 

jUSTERU, syarikat swasta sama ada milik penuh kerajaan atau GLC bukan merupakan 'accounts of the Federation and of the States' dan bukan juga dianggap ''public authorities'  - justeru terlepas daripada Audit oleh Auditor General...

The government can also 'hide' what goes on in these private companies or corporations from Parliament - their expenses, profits, amount they pay their Directors, CEOs, Upper Management and Officers, where the bank in their monies, etc... Even when government work is 'outsourced' to private companies, they can hide even the expenses and profits made...just like they did for the 6P program..When MP Teresa Kok asked about the expenses and the income of the 6P program - the government's reply was simply 'Program 6P dilaksanakan melalui kaedah Private Funding Initiative (PFI), oleh itu Kerajaan tidak menanggung kos operasi badi perlaksanaan program tersebut.' Walaupun ditanya secara khusus di Parlimen - kerajaan boleh dan telah dengan jelas tidak menjawab...contohnya bila MP Teresa Kok bertanya tentang perbelanjaan dan pendapatan kerajaan menjalankan aktiviti 6P - sila lihat soalan MP Teresa Kok, dan jawapan kerajaan tersebut di Who funded the 6P programme? - Private Funding Initiative (PFI)? So who funded, and why?

MAS - We all know that MAS lost money - What was the reason? Why did it happen? Who was responsible? We do not know, but we know more money was injected into MAS - was it about RM6 billion of the people's money...and then, the workers were made to suffer by a massive loss of jobs... The government was more interested in saving the company rather than ensuring the well-being of workers.. 

MAS - kita semua tahu bahawa MAS kehilangan duit - Apakah sebab ini berlaku? Mengapa ini boleh terjadi? Siapakah yang bertanggungjawab? Kita tidak tahu, tetapi kita tahu bahawa lebih kurang 6 billion wang rakyat diberikan kepada MAS untuk menyelamatkan MAS - tetapi selepas itu pekerja dimangsakan dengan kehilangan kerja. Kerajaan nampaknya lebih mahu menyelamatkan syarikat daripada memastikan pekerja tidak dianiyai.

Who funded the 6P programme? - Private Funding Initiative (PFI)? So who funded, and why?

So, nobody is monitoring the government-owned companies or the GLCs - not the auditor, not the ADUNs/MPs or State Legislative Assembly/Parliament.  Who has total control to do as he/she pleases - well, it is Prime Minister/Finance Minister and/or Menteri Besar/Chief Minister...total 'unmonitored' and no need to be accountable control. Hence, we have the problems like 1MDB, MAS, etc...When it comes to government-owned and government linked companies, will government enforcement agencies be doing the needed monitoring to determine that there is no corruption, kleptocracy, misappropriation of funds, etc... as they would be doing for all other non-government-linked companies? I think not...what do you think? Preferential treatment? What do you think?

Kini, tidak ada yang memantau syarikat mlik kerajaan atau GLC - Bukan Auditor General, Bukan ADUN/MP atau Dewan Undangan Negeri/Parlimen - Ini menimbulkan situasi memberi kawalan penuh kepada Perdana Menteri/Menteri Kewangan dan/atau Menteri Besar/Ketua Menteri yang boleh buat sesuka hati tanpa pantauan bebas atau obligasi perlu 'accountable' kepada rakyat. Justeru timbul masalah saperti 1MDB, MAS, dsb...Memandangan syarikat ini milik penuh kerajaan atau GLC, adakah pihak berkuatkuasa membuat pemantauan memastikan tidak ada salah laku, rasuah, kleptocracy, pengambil secara salah wang, dsb.. sapertimana mereka lakukan untuk syarikat swasta yang tak ada kaitan dengan kerajaan? Saya percaya tidak - apa yang kamu fikir?

Would the government-owned companies and GLCs be given special treatment by the government - projects, contracts, etc...? What do you think?

Adakah syarikat milik kerajaan dan GLC diberikan layanan istimewa oleh kerajaan - projek, kontrak, dll..? Apa pemikiran kamu?

Salary and allowance of government are clearly set out - but not the salaries and allowances of these government-owned and GLCs - so they can be  much higher...even the Director's allowances?

Gaji dan elaun penjawat awam jelas ditetapkan - tapi bukan gaji dan elaun dalam syarikat milik penuh kerajaan dan GLCs - justeru gaji/elaun mungkin lebih tinggi...termasuk Elaun Pengarah...? 


WHAT KIND OF WRONGDOINGS COULD BE DONE IN THESE WHOLLY OWNED OR GLC 'Private Companies and Corporations'? A few possibilities are as follows..


BAGAIMANA SYARIKAT SEDEMIKIAN DAPAT DISALAHGUNAKAN? Beberapa kemungkinan saperti dibawah...


1 - Place your people(crony) as an Employee and pay him a very high salary? Then this 'party member' may be expected to pay other party members...or maybe the 'crony' appointee may find a way to give some money to the political party or maybe some politician or party members - a share from his rather high salary? This will, in law, be considered as personal donations...Is it right?

1 - LANTIK kroni atau orang kamu sebagai pekerja dengan gaji yang sangat tinggi. Kemudian 'ahli parti' atau kroni ini akan memastikan beliau salurkan sebahagian wangnya kepada ahli parti, parti atau ahli politik - ini mungkin akan diambil kira sebagai derma peribadi individu oleh undang-undang semasa...'kebocoran wang rakyat?'Adakah ini betul?

2. Appoint your friend or party member as Director and make sure Director allowances are high. Logically, when it is a wholly owned company, it should be public servants from the relevant Ministries who are appointed as Directors - it is their area of work. Other directors may be people who have the necessary experience or skills in the kind of business the said company will be doing. 

Now when government servants appointed as Directors, even if on paper they too get the said Director's allowance - that money they receive must flow back to the government - for, after all, a public servant is just doing their work and they already receive a salary.

[LOOK  at the government owned companies and GLCs - who are the Directors?..Making an ADUN or MP a Director and paying him/her Director's Allowance is wrong - it is also allows for cronyism within the party or coalition. MB ensures ADUN appointed as Director  - - in return full support for MB...is that not CORRUPTION and abuse of power...>]. 

A lot of MP and ADUN, even from the Opposition, also do not want to disclose their income and assets -WHY? By disclosure - we are talking about public disclosure - not just 'secret' disclosure to the PM or MB...

2 - Lantik ahli parti sebagai PENGARAH syarikat dan berikan elaun tinggi - bila syarikat milik penuh kerajaan, melantik Pengarah secara wajar ia harus merupakan penjawat awam daripada Kementerian/Jabatan berkenaan dengan kerja/bidang syarikat berkenaan terlkibat (di mana dalam keadaan ini, elaun Pengarah berkenaan secara wajar akan disalurkan kembali kepada kerajaan kerana penjawat awam berkenaan hanya melakukan kerjanya sebagai penjawat awam, dan dia sudahpun meneriman gaji selaku penjawat awam). 

Pengarah yang lain yang patut dilantik adalah orang yang ada kepakaran dan/atau pengalaman perniagaan yang akan dijalankan oleh syarikat berkenaan..

[Lihat syarikat milik penuh kerajaan dan GLC (kerajaan Persekutuan dan juga Negeri. Siapa kah Pengarah? Membuat ADUN atau MP seorang Pengarah dan membayarnya Elaun Pengarah adalah salah...ini juga menjanakan kronyism dalam parti atau Pakatan parti. MB/PM memastikan seorang ADUN/MP di lantik jadi Pengarah - sebagai balasan mungkin perlu sokong penuh MB/PM - kalau tak sokong tak jadi Pengarah ...tak ada peluang dapat duit lebih berpuluhan ribu setiap bulan.] Fikirkan mengapa ada ramai MP dan ADUN parti pembangkang juga takut mendedahkan sumber pendapatan mereka ...Pendedahan yang diperlukan adalah pendedahan terbuka  kepada orang ramai - bukan hanya pendedahan 'rahsia' kepada PM atau MB?

20 Days after MB Azmin said 'disclose SALARY of top management in GLCs' - looks like 'janji tidak ditepati'?


3 - Using Company Money under the guise of CSR(Corporate Social Responsibility) for the benefit of particular political parties or personalities... - Now, profits from especially 'government owned companies', and GLCs should be flowing back to the investor/shareholders - that means the government - to be used for the benefit of the people openly BY the government(not company)...Other not-owned by the government companies can maybe freely use their money as it pleases...but government fully owned or partially owned companies should make sure that profits (plus whatever else that could be saved or earned) should flow back to the government... for the government to record as income and use that money for the people...Has the Federal Government disclosed the profits it made from the companies it owns - and the fact that the government has received the monies? Did Selangor do so?

3 - Mengunakan duit milik syarikat atas alasan CSR(Corporate Social Responsibility) untuk faedah parti politik tertentu atau ahli politik tertentu - SALAH - apa-apa keuntungan syarikat milik penh (atau sebahagian) kerajaan harus dikembalikan kepada pemegang saham atau pelabur - dalam keadaan ini, ia adalah kerajaan - yang akan mengunakan wang ini untuk faedah orang ramai secara terbuka. Syarikat lain yang tidak dimilik kerajaan boleh buat apa yang mereka suka dengan duit mereka...Tetapi syarikat yang kerajaan memiliki penuh atau sebahagian mesti  menyalurkan keuntungan (dan semua yang boleh diperolehi) kembali pada kerajaan yang akan mengunakannya bagi rakyat...Adakah Kerajaan Persekutuan mendedahkan keuntungan yang diperolehi daripada syarikat milikan kerajaan - dan hakikat bahawa wang itu diterima daripada syarikat berkenaan? Adakah kerajaan Selangor telah berbuat demikian?

MANY OTHER WAYS ...(the above are mere speculations) - now, we look at what should be done...

BANYAK CARA YANG LAIN...(di atas hanya spekulasi saja) - sekarang apa patut dilakukan...

 








What can and should be done by the Federal/State government?

APA YANG BOLEH DILAKUKAN OLEH KERAJAAN PUSAT/NEGERI?

1. Enact laws requiring that all  wholly owned government companies and GLCs are audited by the Auditor General, which must be submitted and discussed in Parliament/State Legislative Assembly...Can also appoint State Auditor General if the Federal Auditor General is incapable. Why enact laws? Because it will guarantee that this is done compared to simply relying on discretionary powers of the PM/MB/CM...

1- Gubal Undang-Undang yang memerlukan semua syarikat milik penuh kerajaan dan GLC di-audit oleh Auditor General - dan lapuran audit harus dibentangkan dan dibincang dalam Parlimen dan/atau Dewan Undangan Negeri...Boleh juga lantik Auditor General peringkat Negeri jika AG Persekutuan tak mahu. Kenapa Undang-Undang? Kerana pasti kena lakukan berbanding arahan budibicara Menteri Besar atau Perdana Menteri...

2 - Enact laws to specifically cover government owned companies and GLCs - which will determine the operations of such companies including the question of salaries and allowances. Proposed that salary/allowances be based on existing public servant rates. This includes also the salay of the CEO and upper management. As an intitiative, annual bonus can be paid out of 10% of Company profits for the year - distribution in determined proportion for the CEO, Upper Management anad also other workers. CEO wages must NEVER be higher than the wages of the Prime Minister/MB/CM. Remember such laws can be anacted at State Level as well for State owned and State GLCs - so Opposition ruled State Governments like Selangor can do it NOW..

2 -  Gubal undang-undang khusus untuk syarikat milik kerajaan dan GLC - yang menetapkan cara perjalanan syarikat milik kerajaan dan GLCs termasuk juga isu gaji dan elaun. Di cadangkan bahawa gaji/elaun ditetapkan berikut skala penjawat awam. Ini termasuk juga gaji CEO dan pegawai pengurusan tertinggi - mungkin untuk memberikan initiatif, boleh ditetapkan BONUS tahunan yang mungkin merupakan 10% keuntungan tahunan syarikat - di agihkan berasaskan peratusan tertentu kepada CEO, pengurusan tertinggi dan mungkin juga pekerja lain. Gaji CEO tidak harus melampaui gaji Perdana Menteri atau Menteri Besar. Ingat undang-undang sedemikian boleh dibuat juga diperingkat Negeri - justeru kerajaan negeri parti Pembangkang saperti Selangor bolehpun melakukan sekarang.

3 - Parliament and/or State Legislative Assemblies can form Committees made up of ADUNs/MPs tasked to continously monitor these governnment owned companies and GLCs

3 - Parlimen dan/atau  Dewan Undangan Negeri boleh menubuhkan Jawatankuasa terdiri daripada ADUN/MP yang ditugaskan memantau perjalanan syarikat milik penuh atau GLC setiap masa...

4 - Every year, the annual report, the Auditor's Report and the Select Committee's report will be tabled in Parliament/State Legislative Assembly for discussions, questions,...

4 - Setiap tahun lapuran tahunan, lapuran Audit serta lapuran Jawatankuasa Pemantau Parlimen/DUN akan dibentangkan di Parlimen/Dewan Undangan Negeri untuk perbincangan, soalan, ...

5 - Enact laws ensuring that all MPs/State Legislative Assemblypersons disclose their income and other interests(shareholdings in company, etc..) including those of their spouses and children. This will be published OPENLY on the Parliamentary/State Legislative Assembly websites. Insist that MPs/ADUNs do not have any other occupation or income (save for income from existing investments or businesses). MP/ADUNs prohibitted from becoming Company Directors and receiving any payment for this EXCEPT in a situation where he/she is the relevant Minister/Deputy Minister/Secretary of the relevant Ministry aor Department[or is the relevant EXCO of the State Government]. In any event, there should be no payment to the said MPs/ADUNs from the said company. Better if ADUN/MPs are not Directors as Parliment/State Legislative Assemblies should be monitoring such companies - hence there should be no 'conflict of interest'


5 - Undang-undang ditetapkan mengenai Ahli Parlimen/ADUN memerlukan mereka bentangkan setiap tahun pendapatan bulanan serta kepentingan lain (pemegangan syer dalam syarikat, dsb..) termasuk juga pendapatan/kepentingan suami/isteri dan anak-anak mereka. Ini akan disiarkan secara terbuka dalam Laman Web Parlimen/DUN. Secara pasti, MP dan ADUN harus tidak ada kerja lain atau pendapatan lain daripada pekerjaan(daripada pelaburan sedia ada atau perniagaan tidak ada masalah). Ahli Parlimen/ADUN dihalang daripada menjadi Pengarah Syarikat dan mendapatkan pembayaran untuk berbuat ini kecuali jika beliau adalah Menteri/Timbalan Menteri/Setiausaha Kementerian/Jabatan berkenaan perniagaan yang dilakukan syarikat berkenaan, atau Exco Kerajaan Negeri berkenaan atau MP/ADUN yang mempunyai pengalaman/skil berkenaan perniagaan syarikat berkenaan dengan syarat khusus bahawa mereka tidak akan menean menerima apa-apa gaji/elaun terus dari syarikat berkenaan - lebih baik ADUN/MP langsung tidak jadi Pengarah Syarikat kerana Parlimen/DUN ditugaskan memantau syarikat berkenaan. Tidak harus ada 'conflict of interest'.


6- As a matter of policy government owned companies and/or GLCs should not be spending their money for anything else other their business operational expenses, AND all profits must be given back to the government becoming government income. As such, such companies should not be using their money as DONATIONS/Contributions to any political parties/organisations or politician directly or indirectly. The said company should also not be handing out humanitarian donations to flood victims, etc - any profits of such companies will flow directly back to the government who then can use the monies for whatever purposes including humanitarian aid for flood victims, etc..This is the peoples' money, and as such these companies should not be using the monies for the people - that is the duty of the government...Wholly private companies can do as they please and use with their money to help the people...

6 - Secara polisi, syarikat milikan kerajaan dan GLC tidak akan membuat apa-apa perbelanjaan lain selain daripada perbelanjaan berkenaan perniagaan mereka dan keuntungan  syarikat akan dipulangkan kepada kerajaan sebagai pendapatan kerajaan. Justeru, syarikat berkenaan tidak boleh mengunakan wang itu sebagai derma/sumbangan kepada mana-mana parti politik/organisasi atau ahli politik sama ada secara terus atau sebaliknya. Syarikat tersebut juga tidak akan memberikan derma/bantuan kemanusian kepada mangsa banjir dsb - keuntungan syarikat terus ke kerajaan yang akan gunakan wang tersebut untuk bantu mangsa banjir, dsb..Ini duit rakyat dan olehkerana itu, syarikat sedemikian tak ada hak belanjakan wang rakyat - itu tugas kerajaan.
